BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY.
I am participating in physical and virtual reality games/exercises conducted by Infusion Play. I recognize that the games require physical exertion that may be strenuous at times and may cause physical injury and I am fully aware of the risks and hazards involved.
I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the above-mentioned program. I represent and warrant that I have no medical condition that would prevent my participation in the program.
I agree to assume full responsibility for any risks, injuries or damage known or unknown which I might incur as a result of participating in the virtual reality games/exercises. Such injuries may include, but are not limited to, nausea, dizziness, blindness, deafness, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness, including death.
By signing below, I agree to accept liability for the equipment used. I understand that should any damages occur that exceed the warranty of the merchandise while the equipment is in my possession, I will be held fully responsible and liable for the full amount of the repairs/replacement of the equipment.
I acknowledge and agree that Infusion Play reserves the absolute right to refuse entry or promptly remove me, or any individual in my party, from the premises if we appear to be intoxicated or under the influence of drugs or alcohol. I further understand and consent that Infusion Play management and staff maintain sole discretion to remove any guest whom they determine poses a risk of damage to the facility and equipment, presents a safety hazard to themselves or others, or causes a noticeable disruption to staff or the overall experience of fellow guests. I acknowledge and explicitly agree that if I, or anyone in my party, is removed under these circumstances, we will not be entitled to a refund, partial refund, or rescheduling of any kind.
I knowingly, voluntarily and expressly waive any claim I may have against the Infusion Play for injury or damages that I may sustain as a result of participating in the games/ exercises.
I, my heirs or representatives forever release, waive, discharge and covenant not to sue Infusion Play for any injury or death caused by their negligence or other acts.
I acknowledge and agree that all services, packages, and purchases at Infusion Play are final sale. I understand that I am not entitled to a refund, and that any services, tokens, or prizes may not be exchanged, returned, or redeemed for cash. I further acknowledge and consent that Infusion Play management and staff maintain sole and absolute discretion regarding the issuance of any refunds, rescheduled services, or any other forms of compensation or alternative resolutions.
I grant permission to Infusion Play for the use of the photograph(s) or electronic media images that are taken during my visit. I understand that I may revoke this authorization at any time by notifying Infusion Play.
I agree to indemnify and hold harmless Infusion Play from any and all claims, liabilities, damages, or expenses (including attorney's fees) arising out of my participation.
I have read the above waiver and release of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.
I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
I recognize that by signing this waiver that I am informed and aware that the waiver will last for one year from the given date of signature.
